I have seen your post and also read the links and what i would appreciate knowing is in what way does dream act impact legal immigration advocacy by IV. I mean are they both not seperate entities and will not IV's entertainement of any discussion on dream act dilute the agenda of IV

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

H1-B quota got filled up on May 26, 2006. You have to wait till April 1, 2007 to apply for H1-B, unless the company falls in the exempt category (non-profit, university...). If the SKIL bill is passed in the lame duck session it can change things as well.

I was wondering about DOL letter which my employer received yesterday..for Recruitment process for 30 days..I wanted to know is it because of the conversion we did to RIR process some days back or is it just that they caught up with my TR application after 5 years..TR-Oct 2001

Hi,
my F-1 Visa expired about a month ago, and I am in my grace period while waiting for my OPT to come through. Yesterday I got the notification that I won the diversity lottery..
My question is as follows:
If I file to change status in the USA, but for some reason I do not get my OPT and get deported, do I lose my chances with the green card? or am I never out of status since I have a pending application? Please help!

it is safe to go with EB3 route. You can file another one in EB2 latter and port the date.

Hi, I have a query regarding the opt to h1b process ,the answer means a lot to me.
I am getting my h1b filed through a desi consultancy in the coming april in premium category.I am on opt and it has its validity till jan 2009.I will be giving interviews for a couple of finance firms in may/june in which i will most likely get one.now my point is i know i can change my job to this new company in june/july since i am on opt .I will take my h1b papers with me but come october i will get into h1b status.will it be a problem for me to remain in the new company which i shifted to, do i have to get back to my old company till i get atleast two pay stubs on h1b or is there any way to continue working in my new fin company without any trouble.the pay slips which i would have got during the months before i shifted jobs will they be suffiecient to get my h1b transfered to the new company.
Gurus pls throw some light. it is really very important for me.

You can file I-485 only when your PD is current. There is no connection between filing for I-485 and I-140 approval.

Hi
My current h-1 B visa in passport expires May 1, 2007. And I have a I-94 valid till May 1, 2007. I already got 3 yr h-1 b extension valid from May 2, 2007. I have to travel to canada in March and I am planning to get the new H-1B visa stamping when I am there instead of making another trip.
Is it possible to go for visa stamping for the extension h-1b, when the intial
H-1B visa is still valid. My understanding is if the visa is issued, all the previous visas will be cancelled. In that case, Can I re-enter US in March with a H-1B valid only from May, 2007

My PD for the EB-2 application is December 2005 BUT I filed my 485 in August 2008 so I am wondering if the US CIS will work on my 485 once my PD is current or will they wait for the PD and the 485 filing date to be current?

Thats correct. Once the I-140 is denied all the status' that comes with it goes away. So EAD, AP etc are no longer valid. Keep on extending H-1B and if the I-140 ever gets denied then you guys can move to H status.

my pd is nov 05 and got an rfe today..dont know what it is..lets discuss all 485 rfe's here..
