You should be able to work use EAD...your husband can still work on H1. First u need to apply for SSN to work.

My husband is on H1 and i am on H4. We recently got our EADs. What I want to know is, can i start working right away with my EAD while my husband works on H1 or are there any rules like my husband also needs should change his status from H1 to EAD so that I may use my EAD card?

My cousin from India has a BCOM degree and he is filing for a H1 B visa.
He just heard from his lawyer 2 days ago that his credit evaluation was needed and he had to get experience letters for atleast 3 years of work ex.
He gave it to his lawyer and now they tell him that they will submit his application without the evaluation! They said that once an inquiry comes if it even does then we will submit the evaluation.
Is that ok??? or should he be submitting the evaluation with the application. I am concerned but I guess it too late now.

A new study by the Transactional Records Access Center (TRAC) finds that the nation's Immigration Courts are becoming increasingly backlogged. Our country's 234 immigration judges received over 350,000 new cases last year, almost 1,500 cases per judge. I was on F-1 when I applied for I-485 (my wife was the primary applicant). My I-20 expired 6 months back, and I'm working on EAD. I'm planning to travel to India and use my AP for return. Will that be fine ?

I recently got my I797 approved (on Oct 19) but, the USCIS denied my extension of stay, and I need to go for stamping in Chennai (as per I797). My question:
1. Can I attend the interview in Canada/Hyderabad consulate instead of Chennai. Company attorney said that should be ok and filing I824 for change of consulate would take long.
In case you wanted to know more details about my case:
-Possess I797 from Employer A until Nov13, 2009.
-Filed for H1b extension with Employer B in Feb, denied in Jun15. payroll with Emp B Feb onwards.
-Re-filed for extn with Emp B in Aug4 finally approved on Oct19 but denied extn of stay.

I have MBA(marketing) Degree from India and 90 Hour Early Childhood Certification and CPR Certificate.
I have been offered a job for the position of LEAD KINDERGARTEN TEACHER in a private CHILD CARE CENTER in MD.
Query :
A) Does the above JOB qualify as H1B?
B) I checked on FLCDATACENTER to determine the prevailing wage for this job - All Industries Database has a higher preveiling wage than what I am offered. Can I use any other wage source?

I have filed my i-485 application with Vermont Service Center sometimes in 2003 or 2004 (do not remember, was a long time ago). The case was transferred to Texas Service Center in March 2007.
I just spoke to the USCIS customer service, and they told me that once case is transferred, the "receipt" date changes to the transfer date. So, due to the "improved service within the TX center" (as USCIS claims), all people who were waiting for adjustment of status and were transferred to the TX are screwed again. On the other hand, people who filed with the TX service center in 2006 retain their original "receipt" date.

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.
Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.
Please suggest.
