Hi,

I have applied for H1-B in India from Comany B in 2007 and got H1-B approved peititon.
Later on I got L1-A visa from my company A in Feb 2008 and came to USA on L1-A visa in Feb2008 and working for comany A till date on L1 visa.

Now I want to change my status from L1A to H1-B to join company C .

My H1 petition is valid till 2010 October. My questions are

1. Can I change my status from L1A to H1B any time before October 2010(H1b expiry date).

if not, How many months before I need to change from L1 to H1b before my H1b petition expires.

2. My current project is still ongoing till October,2010 and I am with L1 status. so Can I wait till October and then apply for change of status to join new company C on H1-B visa.

Hi,
I got my PERM labor approved yesterday, for applying I-140 were can I find the processing dates for I-140? I mean specific to Country? Because, if I go to https://egov.uscis.gov/cris/jsps/Pro...viceCenter=NSC the processing time for "Skilled worker or professional" is April, 1 2008, does this date apply for all? Thanks in advance.

B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

This is my personal opinion, please take attorney's advise.

I have filed my i-485 application with Vermont Service Center sometimes in 2003 or 2004 (do not remember, was a long time ago). The case was transferred to Texas Service Center in March 2007.

I just spoke to the USCIS customer service, and they told me that once case is transferred, the "receipt" date changes to the transfer date. So, due to the "improved service within the TX center" (as USCIS claims), all people who were waiting for adjustment of status and were transferred to the TX are screwed again. On the other hand, people who filed with the TX service center in 2006 retain their original "receipt" date.

P.S. my priority date was current for the past 2 months, however there is still no GC in sight.

My mother has Family based green card, which she got last year. Since then she has been out of the country once and came back on 1st march 2010. My mom wants to go back to india for an year or so, to take care of some matters.....

how do we go on for filing her extension or parole or whataver its called...so that she can stay in India for maximum time and doesnt loose her GC ?

Whats the max time duration extension is granted for ?

For EB2 I - CY 06, in march it was 10150 and now it is 9900. It has gone down by only 250, in line with ~3000 visas/12 monthly allotment. No spillover or anything for the month of march atleast as per the numbers.

Folks,
If your petition has been physically "Mailed" to the Atlanta Service center . Do they give you a tracking number . Can such cases be viewed online on the website http://www.plc.doleta.gov ? How much time does the Atlanta service center take to acknowledge the reciept of such application ?

I am a July 2007 filer. I filed for I-485 using the old fee structure and also applied for AP in July 2007. My AP got approved in 07 but expired so I had to apply for AP in Aug 2008. So I filed in Aug 2008 and paid $305 for AP fee. Now it's to reapply for AP as it expires soon; however I was under the impression that I wouldn't have to pay for AP fee again. I sent the forms to USCIS but the AP package got returned as they claim i don't qualify for free fling.

Anyone else in this position (I am assuming a lot of you guys are... please share your experience). Do we have to pay every year for AP?

Hi,

My Spouse Application was rejected due to incorrect fee though the USCIS were accepting application with old fee till august 17th! It was filed on August3rd! and it was with old fee! Will it be accepted if we send a letter that the fee was right the first time!

Has anybody's both primary and spouse applications got the receipts with old FEES and had applied in AUGUST, Pls reply asap as my spouse application rejected and we had applied on august 3rd!

I am planning to go for visa stamping soon. This will be by 7th year extension. I have the following questions. Thanks for reading my post and for replies.

1) Recently my title changed from "member of technical staff" to "senior member of technical staff" and I got a pay increase. But the job duties is the same. I don't think this needs H1 amendment. Does it ? I also hope that this will not affect the green card processing.

2) This may be a dumb question. I have the approved I-797 but the online status still shows as pending. Since I know at least one USCIS database is not updated, is there a reason to suspect PIMS delay when I go for stamping ? I am planing to go for stamping in Chennai, I assume there is no way to check beforehand. Did anyone else experience the same (online status not updated) and face any delays due to PIMS.

The article says that dates have moved forward because the people whose dates are current, have not applied for their visas

And suppose we could do the same -- if no one applies the gc even once the PD is current, there will be forward movement.... then WHAM! In one go, all could apply

I think we need to expose employers who are taking advantage of us in different ways just because we are stuck with them due to retrogression. This way if we cannot change the legislation right away we can atleast scare the crooks by exposing them so that they cannot trap new people.
