Hello,
I am a brain cancer patient. If something happens to me, Would my wife and children continue to get the GC?
I have filed my I 485 in July 2007. My priority date is Sept 2003 (EB3). My wife has EAD and she is working.
I would really appreciate if somebody replies.

Hello All,
I wanted your advice. I filed for my 485. Then hit retro. Got married. Now got current in June VB. Want to apply wifes 485. EB2 India PD 15 March 04. Initially lawyer said he would do everything in one fees. Now he says he will charge 1000 dollars more since he is filing for wifes separately. I was wondering whether to do it myself. Is it advisable? Has anyone done it succesfully? If so what do you put on top of your application so that USCIS knows I am filing for derivative and my PD is current and so they wont reject the docs? Thanks.

My H1B Visa stamp expires in Jan 08 but H1B Status expires Sept 08. Is it too early to get a new H1B stamp 4 months before expiration of the H1B stamp I currently have.
I am planning to go to Ottawa now for a stamp that expires in Sept 08.

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. I just received my initial EAD and it is only valid for 1 year. My priority date is October 2006. Shouldn�t I have received an EAD valid for 2 years?

is your case eb2 or eb3? what nationality are you from? if you are eb2 india, then it could potentially mean that you might get GC within one year...

I am on H1-B. I filed I-485, I-131 and I-765 in August 2007 under EB3 (ROW). I got married in Sept 2007 but my wife is still in home country due to J-1 2 year HRR. Her 2 years are up in Jan 15, 2008 and she plans to join me on H4.
1. Does my company or I need to do anything for her to apply for a visa at the consulate? Does she take a copy of my H1-B approval marriage certificate and that's it?
2. When she comes the US at the end of January we plan on filing I-485 for her based on my application pending. Can she file for AP and EAD at the same time? Would she be able to work on EAD if it gets approved?
3. I got a letter in the mail today that I have to appear for biometrics on Nov 07, 2007. Does it mean that after my biometrics are taken my GC could get approved right away, even though EB3-ROW is no longer current?
4. After my I-485 has been pending for 180 days, does it mean I could take a similar job anywhere?

I have a rather simple question to ask. I came to the US on a J2 visa with my wife who entered a Ph.D. program. Last year I was accepted into the same program, starting this fall. I didn't change my J2 to J1 because I was waiting for a TAship job offer that would grant me a fee waiver.
Now we're back in the States and there is an on-campus job opportunity that would grant me a fee waiver. I am considering either a) staying on J2 but getting a work permit or b) changing my status to J1.
What I'd like to know is, can I sign a contract with an on-campus employer and start working while my J1 change is being processed? It doesn't really matter much if this means that my paychecks will be delayed; like I said, I would welcome the opportunity to get the fee waiver.

My H1 approval notice was sent to my employer (company A) on sep 10th. I got another job offer from company B in the meanwhile. I would like to start working for company B. I called company A and they said it would take this month end to get the papers. Is there anyway I can start working for company B from Oct 1st (unpaid or any other way) and then take papers(atleast a copy of approval notice) from company A and then apply for h1 transfer in the first week of october?
Please help.

Recently I filed a H1-B Part time Visa. I received the notice from the Lawyer that my application got a RFE on it.
Will they usually show the status online? When I check USCIS, it does not say my case had a RFE on it.
