While renewing, on the form, there are 2 questions:
14 Current Immigration Status
15 Manner of Last Entry
(both seem to have the same answer)

Friends,
I am on H1 right now. I got my H1 last year, Before that I was on OPT (F1). I didnt go to India after I got my H1 and I am employed since the H1 started (Oct 1,2007). I am planning to go to India now in dec. I heard that if you stay more than an year after getting H1 and without getting the passport stamped, I need to fill out an additional form before I got to the visa interview. Is this true??
Secondly, When I applied for H1, I applied thru company A. But even before the H1 started (which is Oct 1,2007) and as soon as my H1 (for company A) got approved (Sept 10, 2007) I applied for H1 transfer to company B. So I was on Company B's H1 from Oct 1,2007 (which is the actual start date of my H1). Now, would this pose a potential problem at the visa interview?
Please clear my doubts guys.

Refugees from Sudan have a tough time with USCIS, let alone people from other nations. Refugees from Sudan have a tough time. Period. It is sad, and we should do what we can to help those less fortunate than us. Again, period. No ifs and buts about it. But is this the right forum, or even the right website?
There is plenty of clutter on these forums.. (And frustratingly, it has spiked a lot in the last week or so). Please do not add to it.

My 6 yr H1B is expiring within 4 months, my company will be filing for the 7th yr extension. Will there be any problem if I send my inlaws for visitor visa now.

I had a H1b visa but never travelled to US.My visa got cancelled without prejudice when i left the organization.My new employer filed l1b individual on my behalf.i129 was denied by uscis stating that i am a skilled worker but do not possess specialized knowledge.Moreover the position in US is that of a software engineer & does not require any specialized knowledge.Please note that I hold a Bachelor of Engineering degree(BE) in Electronics & Telecommunications with about 5 years of IT experience.

Hi,
My I-140 was approved from Nebraska service center, but my attorney sent my I-485 case to Texas. I came across few people here on IV who have experienced the same.
Did USCIS provide any information regarding this? If so could you provide the link?

I have to file for I-485 along with EAD and AP, I live in Phoenix and I am applying for 485 based on an approved I-140 based on NIW. Please let me know if I have to file in the Phoenix lockbox or send it to Nebraska.

Hi,
I have applied for my I140 under EB2, I have a question regarding a gab between my employments. I worked for a company A from Dec 2005 to Feb 2007 and then I switched employers, and I was between projects. The next company I started working for gave me an offer letter only when I found a project (May 2007). So technically there is a 2 month gap. Even the experience letters from that company says I have started work from May 2007.
I'm not sure if this will cause a problem in my I140 stage. Kindly advice.
I have changed two companies after that and I'm filing my GC through the current company. Any response will be much appreciated.

Hi,
I had a question regarding the july bulletin where it was mentioned that Old fees is entertained for employment based petetions while family based it would be new fees for I485.
Mine was applied by my company on July 2nd with old fees and Spouse's was applied on August 3rd with old fee and was rejected! I-140 was approved on August 8th and applied in March 2007!
Did they confuse with family based and rejected for fees?
Spouse should also be employment based right!
Can somebody answer my question?

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My I 485 package was returned as it didnt have the approval notice of I 140, which was submitted a day later than I485 by my company.
It is such a frustrating situation as i have been waiting since 1999 for my GC , and when i got this golden chance my company was not serious enuf to submit the papers in time !
I am doubting the company , as they would have done all this intentionally to keep me in their co. for longer time!The returned letter they have provided me shows no reference no, file no, or either my name ! how can i believe if they have even submitted any papers for I485 or not ?
They say they can refile again .. but duno what to do ??
Can anybody be kind enough to help me out here!

But now i want to file it for my wife in another 2-3 months. Mu queation is that can she travel out of country on her valid H4 visa status while i travel on AP. Will it effects her reentry because I will be using my AP for travel and she dont have AP. Please answer my query.
