I understand that the July VB is reinstated until Aug 17 for new applications for AOS. What happens to AOS applicants of the past? Does this means that the visa numbers are available for restarting processing of those old applications?
Or this reinstatement is restricted only for filing new applications (to abide by INA)? If latter is the case, and earlier option is not viable due to unavailability of visa numbers, then the "current" status (until Aug 17) is not really current, isn't it? Am I understanding this situation correctly?

Hi,
I read an article on Automatic Revalidation.
It says if you have an expired visa, and a valid 797 you can still enter US.
Is it true for H1 extensions?
Please advise.
Thanks

Hi ,
I was in confusing situation, hope you can clarify and help me out.
My wife came to US as H4 in Feb 08.Her i-94 is valid till march 2010.
She applied H1 got H1 approved from Oct08 for 3 years.Since from Oct08 , employer couldnot find project for her.Her employer is asking to move from H1 to H4 back using Cos(i-539).After getting project can move back from H4 to H1 which doesnot come under quota.
My questions are:
1.Is it safe to move from H1 to H4 and back to H1 when she gets project.
2.Her previous H4 i-94 is valid till March 2010.She didnot went to india again.
If she converts from H1 to H4 now, till when she will get i-94(till my H1 valid or original i-94 date).
If she gets i-94 till original i-94 i.e March 2010,does she needs to go to stamping after March 2010 again or continue to be in US even after March or just go for border and get new i-94.
Can you please clarify.
Any suggesstions is really apprecaited.
Thanks
Kumar

Computerworld, which has been the media outlet of choice for the protectionist crowd, reports on one subject addressed by DHS Secretary Janet Napolitano during her testimony this week. Napolitano told the Senate Judiciary Committee that USCIS is stepping up enforcement in the H-1B program. Anti-fraud measures being instituted include site visits. Some of the antis out there probably think that I have a problem with this. They would be wrong. Many of the anecdotes of bad behavior reported by critics of the H-1B program are quite unlawful under existing law.The vast majority of employers comply with the law and are...

Hello,
I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.
1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.
Thanks in advance for any replies.

HuffPost Hill reports on how some of the middle of the roads are planning to vote Thursday on DREAM in the Senate: REID FILES CLOTURE ON DREAM ACT - The bill to create a pathway to citizenship for the children of undocumented immigrants who either attend college or enlist in the military will get a vote Thursday. One fence sitter, Democrat Mark Pryor, will courageously oppose the the bill because it ain't popular in Arkansas. "I will probably be against the DREAM Act, probably on both [cloture and final passage]," Pryor told reporters in the Capitol today. "For one thing,...

Jul 2nd filer. EAD approved late Sep and notice mailed on 10/2/07. (LUD on EAD 10/2)
There is a LUD on the AP application on 10/4/07, but the status still says case received and pending. What could this LUD be ?
When I saw the LUD (with 10/4) I got excited and thought AP was approved too, but when I click the case details , it still says pending. The text of the details did not change.

Hello,
I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.
This is the latest from USCIS : Pls copy paste the entire link
http://www.uscis.gov/USCIS/New%20Structure/Press%20Releases/2009%20Press%20R
eleases/Oct%202009/public_charge_fact_sheet.pdf
it says, that unemployment compensation is not public charge.
Does it even apply to both standard unemployment insurance and the extended benefits.
thanks

Hi,
I am from India.I am on H4(dependent visa),with a stamped expiry date of May 7,2010 on my H4 visa and I-94.I got a J1 offer for further studies in USA.Till I get my required documents for J1 visa,I am guessing it will be beyond this date.My husband has already applied for his visa extension.
1.Now,if I plan to get stamping of J1 in Mexico after the H4 expiry date but with necessary receipts and documents (for H4 related),will I face any problems?
2.Do I need to go to India(my home country) for sure for stamping?
3.Is it better to have status change in USA itself(will delay start of the course)?
Awaiting for feedbacks.

Effective July 6, 2009, U.S. Citizenship and Immigration Services (USCIS) issued an interim rule amending the Department of Homeland Security (DHS) regulations with the intention to:
· end confusion by removing certain obsolete references to the Immigration and Naturalization Service (INS);
· help the public determine the correct place to file USCIS forms; and
· create a more efficient and streamlined process for any future changes to filing processes.
For more information, please visit: www.uscis.gov (http://www.uscis.gov).

Tried to post in another, old thread - no response for several days, so decided to create a new one.
I asked my employer to create sub-account for me at http://www.plc.doleta.gov so I could check my PERM case status without polling them. The employer got back to me and said "looked into the site and I couldnt find the way to create user account to view your case only".
They dont mind making sub-account for me, same way they do for attorneys and paralegals, but they dont want me to see their other pending cases or any information, unrelated to my case. So, my question is: is there a way to create sub-account, which would allow seeing my own case only?
Thanks in advance.

On 10/01/09, President Obama signed a continuing resolution to fund continued federal government operations through October 31, 2009. Included in the legislation were provisions to extend the E-Verify, Religious Worker, Conrad 30 and EB-5 programs.
The continuing resolution was attached to the FY10 Legislative Branch Appropriations bill (H.R. 2918), and was passed by the House of Representatives on 9/25/09 and the Senate on 9/30/09.
The E-Verify, Religious Worker, Conrad 30 and EB-5 programs have all been extended for an additional 30 days, though all they may be extended further in the coming weeks once the Senate and House conference the FY10 Homeland Security Appropriations bill (H.R. 2892).

The week's news dealt a body-blow to the prospects for comprehensive immigration reform, as if the movement to fix our broken immigration laws were blind-sided in a collision with a former pinup driving a pickup -- which it was. With the election of new Massachusetts Senator, Scott Brown, to take the seat of the late Ted Kennedy, the godfather of more humane and just immigration laws, supporters of CIR (Comprehensive Immigration Reform) are swallowing their sadness and putting on their game faces, saying there's still no stopping the CIR train from arriving at its destination. It's hard to maintain optimism,...
