    The nonpartisan Congress.org (http://www.congress.org/congressorg/power_rankings/index.tt) released rankings of the most powerful legislators in Congress this week, and just as interesting as the newly empowered were those hovering at the bottom of the list. Predictably, House Speaker Nancy Pelosi and Senate Majority Leader Harry Reid topped the list, and the list quickly moved to committee chairmen with muscle.

    The rankings took into account the legislators' ability to get things done by the traditional paths of leadership positions and committee assignments but left room for the "sizzle" factor -- reserved for those who "exert or possess power that can't be measured by these standard measures." Specifically mentioned in this category were three presidential candidates, Sens. John McCain (18th), Hillary Clinton (12th) and Barack Obama (27th).

    Sen. Elizabeth Dole, sadly, was not given points for sizzle -- or much else, for that matter. She ranked as the 95th most powerful senator. Yes, that is out of 100. Vying for the bottom rung was also Sen. George Voinovich, who despite serving since 1998 ranked 90th. And as if he hasn't already had a bad year (or two), Rep. William Jefferson came in dead last in the House, awarded negative "fizzle" points due to scandal. Being accused of stashing a $90,000 bribe in his freezer was bound to affect something, since it tipped neither his reelection campaign nor his ability to get a committee assignment.

    I was on H1 with my previous company but laid off last week. I have !485 AOS and EAD.

    I believe I can straight away join any company (consultancy or any enterprise company) on EAD , right pls ?

    if get a job offer from Comapny "A" and join them today and file AC-21 today and meanwhile say I get another job from another Company "B" after two days and join them, can I file another AC-21 without waiting to hear back from USCIS. I believe AC 21 is just informational for USCIS that I have switched the jobs.

    Just asking out of curiosity because when an illegal alien lives and possibly runs from cops from place to place for a period of time then they are qualifed for a green card and eventually citizenship.

    Why would they become nice to them after a certain period of time? It is illegal.

    I heard that there was a deadline to send 45 day letter before end of June this year. And I have seen 45 day letters coming to my friends and me.

    Question is: Is there any deadline for them to complete processing all cases???

    Another concern. When they are done processing all 350K cases, think of retrogression!

    I need feedback from you guys. I have researched this lawyer before I got her to start my greencard and the feedbacks seems that she is efficient and knowledgeable. However, since we signed the contract with her, things have been moving so slow. She doesn't want to talk to me or give me status updates when asked. She has all the information needed from me and my employer to start the prevailing wage request but a month has passes and nothing has been requested yet. Has anybody here experience the same thing?

    Dear All:

    My wife who is on currently in the US on H4 has recently received her H1B approval. Her H1B is valid from 01-Oct-2007 to 23-Sept-2010.

    When we applied for the AOS in July 2007, we mentioned that my wife's current status was H4 (which I am thinking is still true as her H1B starts only on October 2007). My question is will this create an issue when USCIS is adjudicating our AOS applications.

    Any information on this issue would be appreciated.

    I started to notice this back in 2006 when the immigration debate was heating up in Washington. I was getting those annoying email forwards and this time they were of the Lou Dobbsian anti-immigrant variety. The surprising thing to me was that most of them were coming from older family members or acquaintances in the senior citizen set. And since then I've noticed that when I do presentations for civic groups or have observed focus groups on immigration, the older attendees seem to be more hostile.     Pls help me answer this question

    I am one of the July filers, have EAD and applied for I485 EB3, Dec 2003 India. My H-1 And GC are both based on the job title- Systems Programmer/ Network Admin. I wanted to apply for a position in the university - Lab Director- Electrical & Computer Engineering. My question is :

    1) Since not all the job responsibilities will be same in the new job (if i get it). but some ofthe requirements will be the same.
    [like setting up the network, little programming devices etc.]

    2) Can I apply for EB-2 with the university and later port my date- Eb3 to EB2

    Pls let me know at your earliest convenience

    My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was

    a) I filed for my EAD
    b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.

    Both of these cases are currently pending.. My questions are:

    1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?

    2) After answering the RFE, if it is denied, would it impact my GC processing?

    3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.

The referendum passed with 57% of the vote.     I came to US on J1 visa (exchange visitor program) and got waiver and converted to H1 visa. I could not apply for I-140 due to employers problems and now I have short of time for H1 extension.

    Can I convert my visa to J1 again? Is H1 to J1 visa possible? Please advise.

    A new study by the Transactional Records Access Center (TRAC) finds that the nation's Immigration Courts are becoming increasingly backlogged. Our country's 234 immigration judges received over 350,000 new cases last year, almost 1,500 cases per judge. Coupled with the government's onerous "case complete goals", this brings incredible pressure on overworked immigration judges to issue decisions.     I am a July filer and have the option of working for a reputable company as expert consultant for 6 months (initial offer). Yates memo indicates that self-employment is possible. Here is my question: Do we need to register a company to be considered self-employed? As a consultant you may not have a customer for while. Isn't it better to register a company if you want to claim self employment? What are the pros and cons of registering a company?

    FOUR MONTHS into the 110th Congress is too early to assign grades to the new Democratic majority -- but not too soon to remind lawmakers that most of their self-assigned tasks remain undone; that progress in the next few months on immigration, trade and lobbying reform is critical; and that this Congress will be judged on what it accomplished -- and on where it punted.

    The biggest punt thus far concerns entitlement spending, an issue on which the administration, chiefly Treasury Secretary Henry M. Paulson Jr., has been seeking to jump-start discussions. This is an auspicious moment that Democrats seem determined to squander. First, the Democratic Congress has a lame-duck Republican president who could take, or at least share, the blame for cuts that will have to be part of any solution. Second, as members of Congress well know, the longer they wait to take on Medicare and, particularly, Social Security, the harder the problem they will face.

    Democrats have seized on Vice President Cheney's comments to Fox News in January about raising payroll taxes -- "This president has been very, very clear on his position on taxes, and nothing's changed" -- as a rationale for why they can't risk bargaining with the administration. But this is an excuse, not a legitimate basis for inaction. After all, Mr. Cheney also said there would be "no preconditions."

    Meanwhile, lawmakers for the most part have used their oversight powers usefully, though we wish more energy were spent examining torture policies, for instance, and less on subpoenaing the secretary of state. Although the budget process has yet to play itself out, the adoption of tough pay-as-you-go rules to constrain new mandatory spending has had a surprisingly beneficial effect in restraining demands for new programs. The Senate's passage of a measure to strengthen the Food and Drug Administration's regulatory powers is an important step.

    Still unanswered is whether Democrats will deliver on their campaign promises and whether both sides will find ways to forge consensus on issues of common concern. House Democrats' "Six for '06" campaign pledge has so far amounted to "None in '07." Much of this (federal funding for embryonic stem cell research, for instance) is out of Democrats' control, given the Senate's supermajority rules and President Bush's veto pen; in some cases (having Medicare negotiate drug prices, for example), that's just as well. But even such relatively noncontroversial matters as increasing the minimum wage remain undone. Voters are starting to notice, and the coming weeks will be crucial for Democrats to put some actual accomplishments on the board.

    On a matter that is within their control, it's still uncertain whether House Democrats will produce a lobbying and ethics reform package worthy of their campaign pledges to end the "culture of corruption." The key tests will be whether lawmakers require lobbyists to disclose the bundles of campaign cash they deliver (as the Senate version of the measure has done) and whether the House will create a more credible ethics process, including some kind of independent arm to assess and investigate ethics allegations.

    On immigration, Senate Majority Leader Harry M. Reid (D-Nev.) is right to bring to the floor last year's measure, which won the support of 23 Republicans. The clock is ticking on this incendiary topic, and the administration has not improved matters by pushing an unbalanced and punitive plan. If Mr. Bush is looking for a legacy issue beyond Iraq, this could be it, but he is, so far, blowing the chance.

    On trade, an agreement that seems to clear the way for approval of trade pacts with Peru and Panama is a start, but only that. Much more important is the passage of deals with Colombia and South Korea, and extension of presidential trade negotiating authority, which is needed to complete a new global trade treaty. Congressional leaders should work with Mr. Bush to extend the authority -- not because they like or trust him but because doing so will be better for the economy in which they, too, have an important stake.
