The normal process I heard is that they start at the 70 day to complete it by the 90th day. So you can expect it from 70th day onwards.

MY PD is Nov-07. I was just wondering as my GC is for future employment. Can I go back to home country and come back when I get EAD.
What are the limitations in this path. Do we always have to be in USA on valid H1B.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. Is my birth certificate needed to invite my parents on visitor visa? Isn't my SSC certificate showing date of birth and both parents name enough?

I am a july 2nd filer , still waiting for EAD for my spouse .I have got mine a week ago,but her case status has no change. When we call 1-800-375-5283 it says there is no information for this case, however we are able to check the case status online, which says received on October 15, and its still pending.
Another issue is they did not honor the received date.
Is there any one in similar situation?
What can we do at this point? Will Infopass appointment or contacting ombudsman help?

I applied GC labor in Mar 2005 and After 140 approval and 485 is pending morethan 2yrs, i changed my employer by using AC21. After that i recieved a letter from USCIS saying that I-485 denial on May 25th 2010, then after we applied on MTR on June 10th 2010. I recieved an reciept on June 20th 2010.
Can i work now by using an EAD or i need to wait until get the approval on MTR please do advice and when i could get the response from USCIS. My EAd is going to be expire within a couple of months, i applied renewal and i got a reciept on I-765. Please help me on this, really appreciate your help.

Comp A (A Consulting Firm)applied for H1-B in April 2009 thru consular Processing and got approved. I worked for Client X in the month of April but lost my job in a week itself.(thus I dont have any pay Stubs from Comp A)Since Comp A was not able to find me a job. I found A full time job in Comp B in June 2009 , I somehow convinced Comp B to hire me as a contractor as I already have my H1-B approved thru Comp A. Thus from july 2010 I started working for Comp A again as my employer and Comp B as its Client. I am planning to go for VISA stamping in Dec 2010. My Question is
1) If they Ask for my Tax Returns and W2 for 2009 what should I answer as I just have my W2 frm Comp B
2) would there be a question of something like why havent I've been working for Comp A Since my H1 approval.
Please advice. I appreciate any kind of answer

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Yes you can travel with H4 to US with your Wifes H1 and then transfer to H1 if its still vaild at the time of transfer.. Note you can also use your existing H1 as well, As per rule an H1 can be in the US for 6 years. if you have spent some time in between outside US that duration will not be counted in the 6 yrs. So calucate your exact number of days spent in US and if it exceds 6yrs then its not possible to use your existing H1. Note: the days spent on H4 will not be counted in 6 yrs but days spent on L1 will be counted.---

Bottomline - if you are considering converting your LC case from TR to RIR, then your employer must send an email to DOL by Jan 20th and complete recrutiment process by April 1 ( or else case will be closed without recourse to appeal).
